Terms of Service

Spark is an online job ad, profile discovery and contact platform. Spark is designed to let job seekers and work providers publish their own profiles, browse nearby profiles, swipe, match and contact each other when both sides choose to connect.
1. Service provider
Spark is operated by the legal entity identified in the Imprint. Before launch, the service provider must complete the company name, registered address, company registration number, tax number and contact details there.
Spark may use third-party technical providers for hosting, connectivity, email delivery, storage, security and related infrastructure. The current hosting provider is Rackhost Zrt. Spark users enter into these Terms with Spark's operator, not with Rackhost. Rackhost's own hosting terms apply to the separate hosting relationship between Rackhost and Spark's operator.
2. What Spark is
Spark provides a digital space where users create their own worker or employer profiles, publish job-related information, set distance preferences, view profile cards and create a match when both sides express interest.
The free version includes 20 daily swipes. Spark Premium or Spark Unlimited may provide unlimited daily swipes for EUR 10 for the billing period shown at checkout.
3. What Spark is not
Spark does not act as an employment agency, private employment mediator, recruitment agency, labour hire provider, employer, agent or representative of any user.
- Spark does not select, interview, screen or approve candidates.
- Spark does not recommend a specific person or company as suitable.
- Spark does not negotiate pay, hours, contract terms or employment conditions.
- Spark does not guarantee work, hiring, interviews, income or successful cooperation.
- Spark is not a party to any employment contract, service contract or other agreement between users.
4. Eligibility and accounts
Users must be at least 18 years old. Account information must be accurate and kept up to date. A user is responsible for keeping login details secure and for all activity under their account.
One login may hold separate worker and employer profiles. Each profile is a separate identity inside Spark and has its own content, swipes and matches.
5. User content
Users are responsible for the names, photos, descriptions, skills, company names, roles, phone numbers and other information they upload. User content must be lawful, accurate, non-misleading and must not infringe the rights of others.
Spark may remove, restrict or refuse content that appears unlawful, misleading, discriminatory, unsafe, fraudulent, spam-like or otherwise against these Terms or the Moderation Rules.
6. Paid plan
Spark Premium or Spark Unlimited is a paid platform-use feature. It is not a fee for employment, hiring, job placement, worker placement, recruitment success or access to a guaranteed work opportunity.
If Premium is offered, the price, billing period, renewal rules, taxes and cancellation options will be shown before purchase. Users must provide valid payment information and may receive invoices or payment confirmations through Spark or its payment provider.
7. Consumer cancellation
Where mandatory consumer law gives a user a withdrawal or cancellation right, Spark will respect that right. For digital services that start immediately, the checkout may ask the consumer to expressly request immediate performance and acknowledge any legal effect this has on withdrawal rights.
8. Matching and contact details
A match is created only when both profiles express interest. Contact details may be hidden before a match and revealed after a match. Users remain responsible for checking identity, reliability, qualifications, work rights, company status and the legality of any offer or cooperation.
9. Location and distance
Spark uses location only to support distance-based discovery. Employers' offer locations may be stored as a privacy-adjusted point rather than an exact reusable location. Distance values are approximate and must not be used as a guarantee of address, availability or travel time.
10. Prohibited behaviour and content
Users must follow the User Content and Moderation Rules. In short: no fake or misleading profiles, fake jobs, discrimination, scams, advance-fee requests, unsafe or undeclared work, exploitation, trafficking-related content, harassment, hate speech, malware, spam, scraping or unlawful posting of another person's data.
11. Complaints, reports and moderation
Users can report content, profiles, behaviour, billing problems or legal concerns through the Report Content form or the process described in the Complaint Handling Policy. Moderation is handled under the User Content and Moderation Rules.
12. Availability and changes
Spark may be updated, suspended, changed or discontinued. The service is provided with reasonable care, but uninterrupted or error-free availability is not guaranteed.
13. Liability
Spark is not responsible for user-generated content, the accuracy of job offers, profile information, communications between users, or agreements made outside the platform. Nothing in these Terms limits liability where limitation is not permitted by mandatory law.
14. Data protection
Personal data is processed as described in the Privacy Policy. Cookie and similar technology information is available in the Cookie Policy.
15. Governing law
These Terms are intended for a Hungary-based service provider and are governed by Hungarian law, unless mandatory consumer protection rules of another EU member state apply. Users keep any mandatory rights they cannot legally waive.
